Because of the serious human rights situation in Eritrea, both the UDI and Utlendingsnemnda have liberalized their decision practice for Eritrean asylum cases. As of today, a large portion of Eritrean asylum cases are given positive decisions. At the same time, it is important to note that all cases undergo an individual assessment and that some cases are still rejected. The statistics from the UDI for January-November 2005 show that 139 Eritrean asylum seekers received a positive decision, while 5 received a negative decision. (There are no statistics available for Utlendingsnemnda.)
Because of this change of practice, most Eritreans with a final negative decision should send a new appeal to Utlendingsnemnda. If you want NOAS to send an appeal for you, please send a copy of all the case documents to:
NOAS
Postboks 8893 Youngstorget

Or to fax: 22 36 56 61.
Please include your address and phone number. If you do not have all the documents, we will get them from your previous lawyer or from the UDI/Utlendingsnemnda.
We will go through the documents as soon as we are able to. Then, we will let you know if we are able to help you or not. We underline that NOAS always considers in each case if we should send an appeal or not, based on the individual circumstances.
